Party Wall Act
The first time a neighbour typically becomes aware of a potential party wall issue is a party wall notice landing on their door mat. In brief, party wall notices come in three main formats:
- Party Structure Notice
- Notice of Adjacent Excavation
- Line of Junction Notice
These are variously used for actions that directly affect the party wall, excavations close to the party wall and construction of a new wall close to or astride an existing boundary. The building owner is legally obligated to notify the adjoining owner and, whilst a surveyor is not strictly required at this stage, most building owners will ask a Chartered Surveyor to issue the notice to ensure nothing is omitted. The Act is complex and the advice of a professional, familiar with Chard, will avoid mistakes and unnecessary disputes down the line.
